Cash App Data Breach Class Action Lawsuit

Scott Hirsch Law Group, Gustafson Gluek, Migliaccio & Rathod, and Kantrowitz Goldhamer & Graifman, on behalf of two Cash App Investing customers filed a class action lawsuit against the financial application company and its parent Block, Inc., alleging that the companies failed to safeguard customers private information during a December 2021 data breach which was the result of a former employee accessing and taking reports which contained personal information of Cash App Investing customers.  The date breach affected 8.2 million Cash App users.

The Cash App class action lawsuit alleges that Block (formerly Square, Inc.) and Cash App Investing were aware of the risk of the unauthorized disclosure of customer information yet failed to take reasonable steps to safeguard the data. The lawsuit further alleges that although the defendants have not disclosed how the former employee gained access to customer information, the breach proves that the sensitive data was maintained “in a condition vulnerable to misuse.”  Moreover, the lawsuit alleges that even though the defendants discovered in mid-December 2021 that the former employee had gained access to customers’ personally identifiable information, they waited another four months before announcing the breach in a regulatory filing with the Securities and Exchange Commission (SEC).
