Thermos Food Jar Stopper Ejection Defect

Scott Hirsch Law Group PLLC is currently investigating Thermos Stainless King Food Jars and Sportsman Food & Beverage Bottles for issues relating to forceful stopper ejections. This issue affects certain recalled food jars and bottles that may allow pressure to build inside the container, causing the stopper to unexpectedly eject when opened.

Thermos owners have reported stoppers forcefully ejecting from the recalled food jars and bottles when opened after perishable food or beverages were stored inside for an extended period of time. Thermos has received reports of consumers being struck by an ejected stopper, including impact and laceration injuries requiring medical attention. In some reported incidents, consumers suffered permanent vision loss after being struck in the eye. The issue is associated with the lack of a pressure-relief mechanism in the center of the stopper, which can allow pressure to build inside the container and cause the stopper to eject unexpectedly.

Thermos Fails to Remedy

Many customers affected by the recall are left without a complete remedy for the alleged defect. Thermos's recall provides replacement stoppers or bottles but does not compensate consumers for the loss of their products, property damage, or injuries allegedly caused by the defective food jars and bottles. The recall also requires consumers to discontinue use of the affected products and follow a replacement process, leaving consumers who have already experienced the dangerous stopper ejection without compensation for the resulting harm.
