Scott Hirsch Law Group PLLC is currently investigating KTM North America, Inc. regarding over 25,000 model year 2021–2024 GASGAS and Husqvarna off-road competition and enduro motorcycles for dangerous braking system defects. A design or casting defect in the rear brake caliper assembly can cause the caliper body to unexpectedly crack or fracture under ordinary riding conditions, resulting in an immediate loss of rear braking pressure and creating an imminent crash hazard.

Enthusiasts and competitors purchase Husqvarna (TE, FE, FX, TX models) and GASGAS (EC, EX, MC, EW models) off-road motorcycles expecting high-performance engineering capable of handling aggressive terrain, jumps, and high-speed trails. However, reports submitted to consumer safety regulators indicate that rear brake calipers can suffer catastrophic structural failure during use. When the caliper fractures, hydraulic brake fluid rapidly vents, causing the rear brake pedal to go limp and instantly eliminating stopping power. In closed-course and backcountry enduro riding, sudden brake failure dramatically impairs rider control and poses severe risks of crashes, collisions with trees or obstacles, ejections, traumatic fractures, and fatal injuries.

CPSC Fast Track Recall Urges "Stop Riding" While Riders Face Extended Downtime

The U.S. Consumer Product Safety Commission (CPSC Recall No. 26-710) announced a nationwide recall covering approximately 21,040 motorcycles in the United States and over 4,100 in Canada, advising owners to stop riding their bikes immediately until authorized dealers can replace the defective caliper assembly. Despite the severe risk of injury or death, riders report extended dealership wait times, backordered replacement caliper assemblies, and prolonged loss of vehicle utility during peak riding and racing seasons. We are investigating whether KTM North America manufactured and distributed these high-end off-road machines with known brake component vulnerabilities, leaving consumers with unsafe vehicles and diminished market value.
